Setpoint AI LLC ("Setpoint," "we," "our," or "us") operates a software platform for HVAC contractors, property managers, and building operators. This Privacy Policy explains how we collect, use, disclose, and safeguard information when you use the Setpoint platform ("Service").

Payment information
Payment card details are processed by Stripe and are not stored on our servers. We retain billing records such as transaction amounts, dates, and the last four digits of payment cards.
Usage and technical data
We do not sell your personal information to third parties.
We may, in the future, create anonymized, aggregated datasets from operational Customer Data (e.g., anonymized equipment failure rates, regional service trends). We do not currently perform this aggregation; we would only do so once we have a sufficient customer base to ensure the data cannot identify you or your customers. Any such aggregation would be used solely for product improvement and industry research.
Data from connected accounting integrations (such as QuickBooks Online) is excluded from this aggregation. Customer, invoice, and payment data synced through Setpoint’s accounting integrations is used solely to operate that integration for the connected company and is never aggregated, benchmarked, or shared across companies.
Service providers. We work with trusted third-party vendors (including Stripe for payments, and cloud hosting providers) who are bound by contractual obligations to protect your data.
Business transfers. If Setpoint is acquired or merges with another company, your information may be transferred as part of that transaction. We will notify you before your data becomes subject to a different privacy policy.
Legal requirements. We may disclose information if required by law, regulation, or governmental request, or to protect the rights, property, or safety of Setpoint, our customers, or others.
We retain your information for as long as your account is active or as needed to provide the Service. After account termination, you may request an export of your Customer Data within 30 days. We will delete or anonymize your data within 90 days of the end of the retention period, unless required by law to retain it longer.
We implement reasonable technical and organizational measures to protect your information, including encryption in transit (TLS) and at rest, and access controls. No method of electronic storage is 100% secure. If we become aware of a data breach, we will notify you as required by applicable law.

If you are a California resident, you have the right to know what personal information we collect and use, the right to delete personal information, and the right to opt out of the sale of personal information. We use cookies and similar technologies to operate the Service and collect usage data. You can control cookies through your browser settings, though disabling cookies may affect Service functionality.
The Service is not directed to individuals under the age of 18. We do not knowingly collect personal information from minors. If you believe we have done so inadvertently, please contact us.
We may update this Privacy Policy periodically. We will notify you of material changes by email or by posting a notice in the Service at least 14 days before changes take effect.
If you provide your mobile number to a business that uses Setpoint — for example, through an intake form, a service request, or while scheduling — you may receive service-related text messages from that business, such as appointment reminders, “technician on the way” alerts, invoices and payment links, and post-service follow-ups. Consent to receive these messages is not a condition of purchasing any goods or services.
We do not sell or share mobile opt-in information or consent with third parties or affiliates for their own marketing purposes. Mobile information is used solely to deliver the service messages described above.
